1. Acceptance of Terms

By accessing the website and utilizing the IT services, software, and IoT hardware provided by PT Pasifik Niaga Raya (“Pasifik Teknologi”), you agree to be bound by these Terms and Conditions. These terms apply to all corporate clients, partners, and website visitors.

2. Service Level Agreements (SLA)

This website serves as an informational portal and B2B inquiry platform. The actual deployment, integration, and maintenance of our software (SaaS), EV technology, and IoT hardware are governed by separate, specifically negotiated Master Service Agreements (MSA) and Service Level Agreements (SLA) signed by both parties.

3. Intellectual Property Rights

All proprietary source code, algorithms, predictive maintenance models, and UI/UX designs (including behavioral architectures developed in collaboration with surga.tech) remain the exclusive intellectual property of PT Pasifik Niaga Raya. Clients are granted a non-exclusive, non-transferable license to use the software for internal operations during the contract period, unless a specific “White-Label” agreement is executed.

4. Cross-Platform Ecosystem Terms

Our solutions are deeply integrated into a wider technology and physical supply chain ecosystem:

• Physical Spare Parts: Any procurement of physical automotive or EV spare parts triggered by our software is subject to the commercial terms and conditions of pasifikparts.com.
• Maritime & Infrastructure: Extended logistics tracking or offshore server deployments utilizing dermaga.tech and atlantiktekno.com are subject to their respective enterprise service terms.

5. Hardware Integration & Warranties

IoT gateway devices and telematics hardware supplied by us carry a replacement warranty as defined in the SLA. However, PT Pasifik Niaga Raya strictly disclaims any liability for physical damages to vehicles, engine failures, or EV battery degradation that are not directly caused by the malfunction of our IT hardware. Our software provides diagnostic estimations and does not replace regular mechanical inspections.

6. Limitation of Liability

To the maximum extent permitted by law, PT Pasifik Niaga Raya shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, or operational downtime arising from force majeure events, third-party network outages, or improper use of the system by the client’s personnel.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Jakarta, Indonesia.
